1. Acceptance of these Terms

These Terms of Use ("Terms") form a binding agreement between you and Berna Ozer ("Travelog," "we," "us") governing your use of the Travelog mobile application and any associated services (collectively, the "Service"). By downloading, installing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Travelog is a personal travel-tracking application that lets you log countries and cities you have visited, view a passport-style summary of your travels, see "on this day" memories, compare your travels with friends, and earn achievements based on the places you have been. Some features are free; others require a paid subscription or a one-time lifetime purchase ("Premium").

3. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of legal majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian. By using the Service you represent that you meet these requirements.

4. Your account

Travelog can be used as a guest. To unlock cross-device sync, friend features, and the leaderboard, you sign in using Sign in with Apple or Google Sign-In. You are responsible for the security of the Apple or Google account you use; we do not store passwords.

You agree to provide accurate display name and username information, not to impersonate any other person, and not to use someone else's account without permission. We may suspend or terminate accounts that violate these Terms (see §12).

5. Subscriptions, lifetime purchase & free trial

5.1 Pricing & tiers

Travelog Premium is offered through Apple's App Store as:

The current price, currency, and any trial offer for your region are displayed inside the in-app paywall before purchase. Payment is charged to your Apple ID account at confirmation of purchase.

5.2 Free trial

New eligible users may be offered a free introductory trial period (typically 7 days) on the monthly or yearly tier. The trial converts automatically to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. We send a courtesy reminder push 24 hours before the trial converts, but the responsibility to cancel rests with you. Trial eligibility is determined by Apple.

5.3 Auto-renewal & cancellation

Subscriptions automatically renew for the same duration unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your Apple ID Settings → Subscriptions on your device. Removing the Travelog app does not cancel your subscription.

5.4 Refunds

All purchases are processed by Apple. Refund requests must be made through Apple at reportaproblem.apple.com. We cannot process refunds directly.

5.5 Lifetime purchase

The lifetime purchase is a one-time payment that grants access to Premium features for the lifetime of the Service. It does not auto-renew. "Lifetime" means the operational life of the Travelog Service as published by us; should the Service be permanently shut down, lifetime purchasers will receive at least 30 days' notice (see §12.2).

5.6 Family Sharing

The lifetime purchase supports Apple Family Sharing. Subscriptions do not. Premium entitlements obtained via Family Sharing are governed by Apple's Family Sharing rules.

5.7 Price changes

We may change subscription prices for future renewal periods. Apple will notify you of any price increase and ask you to confirm before the new price takes effect, in line with App Store rules.

6. Your content

You retain ownership of the content you create in Travelog — your check-ins, photos you import, custom labels, profile information ("Your Content"). By using the Service you grant Travelog a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating and improving the Service for you and (where you have made it visible, e.g. via friends or a public profile) for the audience you have chosen.

Photos you choose to import for GPS extraction are processed on-device. We extract the country/city + timestamp from EXIF metadata; the photo file itself is not uploaded to our servers unless you explicitly share a memory card image.

7. Acceptable use

You agree NOT to:

We reserve the right to remove content and suspend or terminate accounts that violate this section, with or without notice depending on severity.

8. Intellectual property

The Service — including its app icon, logo, design, code, original artwork, achievement badges, and the "Travelog" name — is owned by Berna Ozer and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by these Terms or by applicable law.

9. Third-party services

The Service relies on third-party platforms — including Apple, Google Firebase, and Google Sign-In — to operate. Your use of those underlying services is also subject to their respective terms and privacy policies. We are not responsible for outages, data losses, or policy changes by those third parties.

This app is provided through the Apple App Store. The standard "Licensed Application End User License Agreement" between you and Apple, found at apple.com/legal/internet-services/itunes/dev/stdeula, applies to your installation. To the extent these Terms conflict with that EULA, the EULA controls solely with respect to the App Store license; everything else is governed by these Terms.

10. Disclaimers

Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, error-free, secure from intrusion, or that any data you store will be preserved without loss. We do not guarantee the accuracy of any country/city detection from your photos' GPS metadata, the completeness of leaderboards, or the timing of push notifications (which Apple ultimately controls). You use the Service at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, in no event shall Berna Ozer (Travelog) be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Service.

Our total cumulative liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to liability, or (b) twenty US dollars (US$20).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the above limitations apply only to the extent permitted.

12. Termination

12.1 By you

You may stop using the Service at any time. To delete your account and associated data, use Profile → Settings → Delete Account in the app, or contact us at the address in §15. Subscriptions must be cancelled through your Apple ID Subscriptions settings (deleting the app does not cancel a subscription).

12.2 By us

We may suspend or terminate your access if you violate these Terms, if required to comply with a legal obligation, or if continued access poses a security risk. If we permanently discontinue the Service, we will provide at least 30 days' notice in-app and via email (if you have an account), and lifetime purchasers will have an opportunity to export their travel data before shutdown.

13. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws principles. The state and federal courts located in Delaware shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws give you the right to bring claims in your local courts under local law, nothing in this section limits those rights.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top. For material changes that affect your rights, we will provide reasonable advance notice in-app on next launch and (if you have an account) by email. Continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms.
